Participant Waiver, Release, Indemnification of All Claims & Agreement Not to Sue

NOTICE: THIS IS A LEGALLY BINDING AGREEMENT.

Please read this document carefully and in entirety. By signing this agreement, you give up your right to bring a court action to recover compensation, damages or obtain any other remedy for any illness, bodily injury, death or property damage caused to you or your minor dependents arising out of participation in Kentucky Bourbon Influencer events, now or at any time in the future.


ACKNOWLEDGEMENT AND ASSUMPTION OF RISK:
I hereby acknowledge and agree that participation in membership activities comes with inherent dangers and risks including, without limitation, the risk of illness or injury, death or property damage. I have full knowledge and understanding of the inherent dangers and risks associated with membership participation and consumption of alcohol. I assume full responsibility for and risk of illness, bodily injury, death or property damage caused by improper or overconsumption of alcohol. The above list does not limit the operation of this agreement.


MEMBERSHIP/CODE OF CONDUCT/NATIONWIDE DISCLAIMER:
The Kentucky Bourbon Influencers are a charitable, non-profit membership organization. I understand that the KBI will have no liability or responsibility for any personal and physical injuries including death or for any loss or damage to personal property, sustained by the member(s) while participating in any program activities. I understand that my ID must be presented and I must be at least 21 years of age to participate in activities that involve alcohol consumption.


CODE OF CONDUCT
ALL MEMBERS OF KBI SHALL BE BOUND BY THIS CODE OF CONDUCT.

MEMBERS HAVE A RIGHT TO:

  • BE TREATED FAIRLY, EQUALLY AND WITH RESPECT BY THE CLUB, ITS BOARD AND OTHER MEMBERS.
  • SOCIALIZE IN AN ENVIRONMENT FREE FROM ALL FORMS OF HARASSMENT AND DISCRIMINATION.
  • PRIVACY AND CONFIDENTIALITY CONCERNING RECORDS, DOCUMENTATION AND ANY OTHER COMMUNICATION CONTAINING A MEMBER’S PERSONAL INFORMATION, UNLESS CONSENT IS OTHERWISE PROVIDED.
  • BE INFORMED AND ACTIVELY INVOLVED IN ALL CLUB EVENTS AND OFFERINGS.
  • VOICE THEIR OPINIONS, REQUIREMENTS AND SUGGESTIONS TO THE COMMITTEE.
MEMBERS MUST:
  • TREAT OTHER MEMBERS, GUESTS, STAFF OF VENUES AND OTHER PATRONS (WHERE A SOCIAL CLUB FUNCTION IS BEING HELD) FAIRLY, EQUALLY AND WITH RESPECT AND COURTESY.
  • BEHAVE RESPONSIBLY AND ENSURE THEY CONDUCT THEMSELVES IN A MANNER WHICH WILL NOT INJURE THE REPUTATION OF THE CLUB (KBI) , ITS EVENTS, ORGANIZERS, PARTICIPANTS OR SPONSORS.
  • NOT PHYSICALLY OR VERBALLY HARASS OTHERS.
  • REPORT ANY INAPPROPRIATE BEHAVIOR OF A MEMBER TO THE BOARD FOR ACTION AND FOLLOW UP.
  • ABIDE BY THE KBI CODE OF CONDUCT.
  • DRINK RESPONSIBLY, AND IF NEEDED AT ANY TIME, NOTIFY ANOTHER MEMBER OR BOARD MEMBER OF THE NEED FOR ARRANGING ALTERNATIVE TRANSPORTATION.
  • PAY ANY FEES IN RELATION TO AN EVENT, OR OFFERING (E.G. TICKETS OR MEMBERSHIPS) WHICH THAT MEMBER HAS COMMITTED TO, REGARDLESS OF WHETHER THE MEMBER ATTENDS THE EVENT OR NOT.
  • NOT USE THEIR MEMBERSHIP PRIVILEGES TO PURCHASE TICKETS TO ANY EVENT OR OTHER OFFERING, AT A MEMBERSHIP PRICE, FOR NON MEMBERS OF THE ASSOCIATION (EXCEPT FOR PARTIES ENTITLED TO SUCH PRICES AS NOMINATED FROM TIME TO TIME).
  • IF ON SELLING A TICKET TO AN EVENT WHICH THE MEMBER HAS BOOKED ON TO AND PAID MEMBERSHIP RATES, IF THE TICKET IS SOLD TO A NON MEMBER, THE NON MEMBER PRICE MUST BE PAID FOR BY THE RECIPIENT OF THE TICKET AND THEN THE DIFFERENCE ON FORWARDED TO THE CLUB.
BREACHES OF THIS CODE OF CONDUCT:
  • ANY MEMBER NOT BEHAVING IN ACCORDANCE WITH THE TERMS OF THE CODE OF CONDUCT AT AN EVENT OF THE BOARD MAY BE ASKED TO LEAVE THE FUNCTION AND WILL NOT BE ENTITLED TO A REFUND OF ANY MONIES PAID.
  • THE INAPPROPRIATE BEHAVIOR OF ANY MEMBERS WILL BE INVESTIGATED, DISCUSSED AND AN APPROPRIATE COURSE OF ACTION WILL BE TAKEN BY THE BOARD, WHICH MAY BE SUBJECT TO A REPRIMAND, SUSPENSION OR REVOCATION OF MEMBERSHIP.

WAIVER, RELEASE, INDEMNIFICATION & COVENANT NOT TO SUE:
In consideration of my participation in KBI membership, I agree and on behalf of myself, my dependents, my heirs, representatives, executors, administrators, and assigns agree and do HEREBY RELEASE KBI and its officers, directors, employees, volunteers, agents, representatives and insurers (“Releasees”) from any causes of action, claims, or demands of any nature whatsoever including, but in no way limited to, claims of negligence whether passive or active, which I, my heirs, representatives, executors, administrators and assigns may have, now or in the future, against KBI on account of personal injury, property damage, death or accident of any kind, arising out of or in any way related to the participation in KBI events.

I agree to INDEMNIFY AND HOLD HARMLESS, KBI and its Releasees from any and all causes of action, liabilities, claims, demands, losses, or costs of any nature whatsoever arising out of or in any way related to my membership participation that they may incur for any reason whatsoever.


MISCELLANEOUS:
I hereby certify that I have full knowledge of the nature and extent of the risks inherent in membership participation and that I am voluntarily assuming said risks on my behalf. I understand that this agreement is a promise not to sue and a release of and indemnification for all claims. I further expressly agree that the forgoing assumption of risk, release and waiver of liability and indemnity agreement is intended to be as broad and inclusive as is permitted by the laws of the Commonwealth of Kentucky and that if any portion thereof is held invalid, it is agreed that the rest of the agreement shall, notwithstanding, continue in full legal force and effect.

I further certify that I am in good health and that I have no conditions or impairments which would preclude my safe participation in membership and will report any significant changes that would impair the ability for my safe participation in KBI membership.
